Below are the Terms of Service ("KY Unlimited Inc, KY Unlimited, KYUnlimited, KYU", "We", "Us", "The Designer") These Terms of Service set forth are specifically listed to manage expectations and outcomes, and protect both you "The Client" and “KY Unlimited”". Your use of kyunlimited.com constitutes your agreement to all such Terms. It is highly crucial that you ("The Customer", "The Client") take time to read through thoroughly and ensure you fully understand these Terms of Service and their significance before you contract KYU for any project. 

 

KYUnlimited reserves the right, in its sole discretion, to change the Terms under which kyunlimited.com is offered. The most current version of the Terms will supersede all previous versions. KYUnlimited encourages you to periodically review the Terms to stay informed of our updates.

 

"The Client" agrees to 

 

Payments: Payments can be done through the website or as a Square invoice. All invoices will be sent once the client and KYUnlimited both agree on the specific pricing for the project. Invoices must be paid within 72 hours or the invoice will be canceled until the client is ready to continue the service. All projects over $500 require a 50% non-refundable deposit in order to begin the design process and anything under $500 shall be paid in full by the client. 50% final payment plus any additional discussed service fees are due when the initial design is completed and prior to any finalization. For further completion or transfers, the remaining balance must be paid in full.  Payments accepted include any listed on our checkout. No project shall be started on without proper payment being received from the client to KYUnlimited.

 

Refund Policy: All projects are subject to a complete 100% non-refundable payment from the client. Please understand that under no circumstance can a refund be given especially after work (including proofs) have been issued and/or labor has begun. No refunds or exchanges are given for any promotional sale prices and all sale invoices must be paid in full. If for any reason the client cancels services, no payment shall be reimbursed and becomes forfeited by the client. 

 

Process + Completion: Graphic Design Projects completion time varies from anywhere from 1-2 weeks to up to 21 business days when content is submitted for said project. 

Web Design Projects completion time varies from 4-6 weeks when content is submitted for said project. This does not include the revision stages. All projects are calculated by 7 working business days, with the exception of holidays, company vacations, observed holidays and weekends. We want to acknowledge we may or may not send out a daily/weekly update. The Revision Stage is NOT included in the completion time. Revision Stage can be from anywhere from 1 business day up to 10 business days.

 

Revisions: You receive a numerical limit of revisions in every package. 

Once all the revisions are exhausted, a fee will occur for any additional revisions after. 

Once you have submitted all of the revisions in your package and your project is emailed, made live, or logo files emailed over, the remaining revisions in which you did not use EXPIRE immediately.

Communication: Clients may receive a 1 year grace period with KYUnlimited for desired services if they choose not to begin on the original date but client must communicate they would like to hold the project. Any timeframe after 1 year or failure to communicate within 60 days of the original order date becomes forfeited. Once promotional items have been started, no refund shall be reimbursed unless it is a fault of the designer. If a client leaves a project prior to completing the remaining payment, the project will be canceled after 60 days of being abandoned. To restart the project, the client must pay the remaining balance plus an additional $125 restart fee for website and package orders and $75 for individual designs.

 

Confidentiality: Confidential design projects (non-disclosure agreements) require order purchases exceeding $500 and/or recurring monthly subscription packages that obtain an additional design fee in agreement with accordance. This agreement varies on clientele needs but includes (not limited to) removal of our design watermark in the footer of the clients website; no project content public post (does not include being exempt from client work posted into design portfolio).

A 5% disclosure fee will be sent separately after the order is placed. The agreement is not official until this amount and policy is completed.

 

ADDITIONAL INFORMATION: 

Draft files (revision files, non-selected logo proofs, premium paid fonts and themes, .PSDS,) remain the property of KY Unlimited. DO NOT POST PROOF OR EXAMPLE WORK.

At all times, all correspondence is done via email, that is to protect You, "The Client" and "The Designer" from hearsay.It is done so to keep a paper trail for records to avoid miscommunication and that can be used for clarification, if needed. These terms are listed visibly on our Payment Processors: Paypal & Square invoices, website, before & during hire emails and are to be read in full before hire.
